1. Agreement to these terms

By creating an account, signing in or using Kambio, you agree to these Terms and Conditions and to the Privacy Policy. If you do not agree, you must not use the service.

Kambio may update these terms when the service, legal requirements or business needs change. Material changes will be communicated through the service or by email where appropriate. Continued use after the effective date means you accept the updated terms.

2. Eligibility and account security

You must be at least 16 years old, or the minimum age required in your country to use online services without parental consent, to use Kambio. If local law requires a higher age for consent, that higher age applies.

You are responsible for keeping your sign-in method secure and for all activity under your account. You must provide accurate profile information and keep it up to date.

3. What Kambio provides

Kambio provides tools for peer-to-peer language exchange, including profiles, partner discovery, matching, scheduling, guided conversation prompts, vocabulary support and browser-based video sessions.

Kambio does not employ users as teachers, does not guarantee educational outcomes, does not verify every statement made by users and does not supervise every conversation in real time.

4. User conduct

You agree to use Kambio respectfully and lawfully. You must not harass, threaten, discriminate against, exploit, impersonate, spam, scam or otherwise harm other users.

You must not upload or share illegal, hateful, sexually explicit, violent, deceptive or infringing content. You must not attempt to bypass security, scrape the service, interfere with availability or use Kambio for commercial solicitation without written permission.

5. Video sessions and user content

You are responsible for the content you add to Kambio, including profile text, photos, messages, notes and anything you say or share during sessions.

You keep ownership of your content, but you grant Kambio a limited, worldwide, non-exclusive licence to host, store, display, transmit and process it as needed to operate, secure and improve the service.

You must not record, screenshot, publish or distribute another user's conversation, image, voice, profile or personal information without their consent unless required by law.

6. Subscriptions, trials and payments

Kambio may offer a free trial and paid subscription. Prices, billing periods, trial length and included features are shown on the pricing page or during checkout before purchase.

Payments are processed by a third-party payment provider. Unless stated otherwise at checkout, subscriptions renew automatically until cancelled. You can cancel from account settings or through the payment flow made available to you.

Refunds are provided only where required by applicable law or expressly stated by Kambio. If you are a consumer in a jurisdiction with mandatory withdrawal or cancellation rights, those rights are not limited by these terms.

7. Moderation and enforcement

Kambio may investigate reports, remove content, limit features, suspend or terminate accounts and preserve information where reasonably necessary to protect users, comply with law or enforce these terms.

If your account is terminated for serious or repeated violations, you must not create another account without permission.

8. Third-party services

Kambio uses third-party providers for authentication, database hosting, video calls, payment processing and email delivery. Your use of those integrated services may also be subject to their own terms and privacy notices.

Kambio is not responsible for third-party services outside its control, but will use reasonable care when selecting and configuring providers.

9. Availability and changes

Kambio is provided on an as-is and as-available basis. The service may be interrupted for maintenance, upgrades, security incidents or reasons outside Kambio's control.

Features may be added, changed or removed. Kambio will try to avoid changes that materially reduce paid features during an active billing period without appropriate notice or remedy.

10. Intellectual property

Kambio, its branding, interface, software, prompts, curated vocabulary and other service materials are owned by Kambio or its licensors and are protected by intellectual property laws.

You may use Kambio only as permitted by these terms. No rights are granted except those necessary to access and use the service.

11. Liability

Nothing in these terms excludes liability that cannot be excluded under applicable law. To the maximum extent permitted by law, Kambio is not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data or user conduct outside Kambio's reasonable control.

Where liability may be limited, Kambio's aggregate liability relating to the service is limited to the amount you paid to Kambio in the 12 months before the claim, or EUR 100 if you did not pay anything.
